Description: On December 11, 2010, Plaintiff was walking on the sidewalk when a plain clothes police officer assaulted him without warning from behind, knocking him down. Plaintiff was able to stand up but the unidentified officer struck Plaintiff with a metal baton, injuring Plaintiff’s arm. Plaintiff then curled on the sidewalk in a defensive position while the unidentified officer beating him from above. Defendant Officer Joseph Abel exited an unmarked van and joined the assault, placing Plaintiff in an illegal chokehold. Defendant Abel pinned Plaintiff’s injured arms behind his back, handcuffed him and moved Plaintiff to a van for transportation to the 25th Precinct.

Description: Defendant Neftali Betances arrested plaintiff while he was playing games in an electronics store in connection with a buy-and-bust drug transaction that allegedly occurred across the street 10 minutes earlier in the presence of defendant Undercover Officer C0039.
