Description: On or about May 11, 2017, on a street in the Bronx, Defendants NYPD Officers unlawfully touched, grabbed, handcuffed and seized the Plaintiff Javier Rodriguez in an excessive manner about his person, causing him physical pain and mental suffering, in retaliation for Plaintiff recording Defendants, as they detained his friend at gun point. Defendants claimed falsely that Plaintiff, at the time of the incident, was in his friend's car smoking marijuana. Indeed, Plaintiff at no point smoked or even saw marijuana in the car. After being falsely arrested, Plaintiff was thereafter held in custody over the course of two (2) days or approximately twenty-nine (29) hours until he was released.
