Plaintiff, through his cell phone, recorded the interaction. Plaintiff then walked away, but noticing the plaintiff's actions, defendants followed plaintiff and stopped, handcuffed, and arrested plaintiff. Description: On or about May 11, 2017, on a street in the Bronx, Defendants NYPD Officers unlawfully touched, grabbed, handcuffed and seized the Plaintiff Javier Rodriguez in an excessive manner about his person, causing him physical pain and mental suffering, in retaliation for Plaintiff recording Defendants, as they detained his friend at gun point. Defendants claimed falsely that Plaintiff, at the time of the incident, was in his friend's car smoking marijuana. Indeed, Plaintiff at no point smoked or even saw marijuana in the car.
