Description: On June 10, 2015, plaintiff was walking down a street in the Bronx when defendant NYPD officer Fabio Checo (Shield No. 8177) pulled up on him in an unmarked car and told him to stop. Defendant Checo, along with defendant NYPD officers Moises Garcia (Shield No. 5782) and Thomas Warkenthien (Shield No. 3876) then chased plaintiff down the street. Defendant Checo then exited his vehicle and drew his gun on plaintiff, noting that he would shoot plaintiff to stop him. Defendants Checo, Garcia and Wakenthien then tackled plaintiff to the ground, punched him, kicked him, beat him and handcuffed him.
