Description: Defendant Officers received a radio run about a drug transaction inside a location and stopped Plaintiff as he was in the hallway. They searched his jacket pocket without conducting a pat down, recovered a gun, arrested Plaintiff, brought him to the 73rd Precinct, and charged him with Criminal Possession of a Weapon in the Second and Fourth Degree & Criminal Possession of a Controlled Substance in the Fifth and Seventh Degree. Plaintiff was convicted by a jury but an appellate Judge overturned the conviction saying the evidence should have been suppressed.

Plaintiff was then brought to the 81st Precinct, strip-searched, interrogated about drugs, and then charged with solely resisting arrest, which was ACD'd at arraignments.
