They searched his jacket pocket without conducting a pat down, recovered a gun, arrested Plaintiff, brought him to the 73rd Precinct, and charged him with Criminal Possession of a Weapon in the Second and Fourth Degree & Criminal Possession of a Controlled Substance in the Fifth and Seventh Degree. Plaintiff was convicted by a jury but an appellate Judge overturned the conviction saying the evidence should have been suppressed.
