Description: Defendant Officers received a radio run about a drug transaction inside a location and stopped Plaintiff as he was in the hallway. They searched his jacket pocket without conducting a pat down, recovered a gun, arrested Plaintiff, brought him to the 73rd Precinct, and charged him with Criminal Possession of a Weapon in the Second and Fourth Degree & Criminal Possession of a Controlled Substance in the Fifth and Seventh Degree. Plaintiff was convicted by a jury but an appellate Judge overturned the conviction saying the evidence should have been suppressed.

Description: Defendant Officers pulled up to Plaintiff in an unmarked vehicle while he was on the street, asked to "check him", Plaintiff complied, and officers then searched him and tightly handcuffed him.
