Description: On November 14, 2013, Plaintiff was inside her kitchen while gardeners were outside working on her lawn. Plaintiff was a tenured guidance counsellor with the DOE on bed rest medical leave during her seventh month of pregnancy with twins. Plaintiff went to her lawn to mediate the dispute with a neighbor, Defendant Ernst Jabouin, about leaves being blown across the street. Plaintiff was holding the potato peeler she had been using, but Defendant Jabouin accused her of having a knife. Because of the threats Plaintiff went in and called 911.
