Description: On November 14, 2013, Plaintiff was inside her kitchen while gardeners were outside working on her lawn. Plaintiff was a tenured guidance counsellor with the DOE on bed rest medical leave during her seventh month of pregnancy with twins. Plaintiff went to her lawn to mediate the dispute with a neighbor, Defendant Ernst Jabouin, about leaves being blown across the street. Plaintiff was holding the potato peeler she had been using, but Defendant Jabouin accused her of having a knife. Because of the threats Plaintiff went in and called 911. Five NYPD vehicles arrived shortly thereafter. The officers interviewed Defendant Jabouin first, then refused to speak to the gardeners. When questioned whether she own...
