Description: On or about June 5, 2020, plaintiff Charles Blake was standing in front of his home in the Bronx, New York, some time after 8:00 P.M. Because of a Curfew Order implemented in the wake of the death of George Floyd in late May 2020, Mr. Blake was approached by a number of police officers, including defendants Alifonzo, Vareika, Indiviglia, and three other John Doe officers. When they approached, they immediately ordered plaintiff to put his hands behind his back. They then forced him to the ground, injuring his eye, handcuffed him, and took him into custody. He was held in custody for several hours before being released and issued a desk appearance ticket, which was dismissed on June 9, 2020.

Description: On September 12, 2016, at approximately 1:00 am, Plaintiff was lawfully sitting inside of a legally parked motor vehicle in front of 260 Brook Avenue when Defendant police officers unlawfully approached the vehicle, knocked on the driver's window, and told Plaintiff they needed to search the vehicle. Plaintiff told the officers he needed to call the owner of the vehicle, who was inside of 260 Brook Avenue to inform him of what was happening.
