CAILLE DIEUVERSON, a black male, was lawfully in the vicinity of 154 Lawrence Avenue, County of Kings, City and State of New York when he was unlawfully stopped, detained, battered and assaulted, seized and searched, and falsely arrested by defendants JOHN CHERY and JOHN or JANE DOE 1-10. Plaintiff was unlawfully searched, had excessively tight metal handcuffs affixed to him and charged when defendants signed and forwarded to the criminal court a complaint to the District Attorney’s Office, in which they knowingly fabricated allegations against Plaintiff, namely that plaintiff committed the criminal offense of assault, when said Defendant observed no such conduct. Description: On December 9, 2020, around 9:00 AM, Plaintiff Kenny Mathieu was at home at 1930 Brooklyn Avenue, Brooklyn when he was subject to an unlawful search, including a pat down search, by Defendant NYPD Detectives John Chery and Brian Weinstein and Officers Corey Anderson and John Does 1-10. Plaintiff was transported with his hands cuffed behind his back to the 77th precinct, where he was interrogated about a gunpoint robbery that had occurred on September 23, 2020. After 24 hours at the precinct, Plaintiff was transported to King's County Central Booking, where Defendant officers provided the KC DA with false, misleading, and/or incomplete information.
