Description: On July 4, 2022, plaintiff, an African-American man, was lawfully walking down a sidewalk in Queens when he was approached by defendant NYPD Officers Timothy Lerner and Nicholas Couvaris. Without any probale cause or reasonable suspicion, defendants stopped plaintiff and asked him to present his ID and tell them where he was going. When plaintiff declined and attempted to leave, defendants followed him and called for backup. Defendant Officers Michael Marzullo, James Barrett, Nicholas Schneider, Alex Desantis, Kyle Mclernon, and Hernan Contreras joined the others in cornering plaintiff.
