Description: On or about August 18th, 2016, Plaintiff was lawfully present outside the residence of her mother-in-law's home, having arrived earlier that day to help out after her father-in-law's recent passing. Plaintiff had accidentally been locked out of the house after stepping outside, and called 911 for assistance in getting back inside. When officers arrived, Plaintiff's bother-in-law falsely told them that Plaintiff had damaged the front door, even though upon inspection there was no visible damage and Plaintiff's mother-in-law affirmed that there was no damage to the door. Description: On August 14, 2016 Plaintiff was present at Churh Av and 39th st when he was approached by Officers James Aiello, Carl Scogmanillo and other unnamed officers. They detained plaintiff, took his bike without permission and then issued traffic tickets and a criminal court summons summons that the complaint alleges were falsely made. All traffic tickets and criminal summons were dismissed and sealed.
