Description: On or about May 6th, 2018, Plaintiff was lawfully present on the sidewalk when he was approached by PO Daniel Gerardi and SGT Robert Martinez of the NYPD. Plaintiff had committed no crime, nor was he involved in any suspicious activity. PO Gerardi and SGT Martinez then proceeded to assault and then batter the Plaintiff, causing severe physical, psychological and emotional harm. Plaintiff was then placed under arrest and transported to the local precinct where he was unlawfully detained. As a result of the excessive force used in the arrest of Plaintiff, Plaintiff's lawful spouse suffered the loss of consortium of her husband.
