Complaint
Description: On January 9, 2013, defendant PO Benjamin Young entered plaintiff's apartment without a warrant and arrested plaintiff based on false and unsubstantiated allegations regarding a violation of a Family Court Order of Protection. After the District Attorney's office declined to prosecute the case, plaintiff and his attorney were repeatedly harassed over the phone by defendant PO Rodrigo Fonteboa regarding the alleged violation. On January 30, 2013, plaintiff was re-arrested, re-processed and re-charged for a violation of the same Family Court Order of Protection that was the basis for the initial arrest.
