Description: On May 29, 2020, the plaintiffs, both New York State legislators, were participating in a protest at the Barclay's Center in Brooklyn. The peaceful protest was organized after the deaths of Breonna Taylor and George Floyd in May 2020. Plaintiffs identified themselves as lawmakers to police officials before and during the protests. Shortly before 8 AM, the defendant NYPD officers broadcast a message to the protesters, telling them to disperse, despite having no legal basis for this order. Plaintiffs attempted to comply with these commands, but the NYPD officers "kettled" them in place, leaving them with nowhere to go. Description: On January 24, 2020 at approximately 10:00 P.M., plaintiff Jeremiah Kendall, was lawfully present in the vicinity of Hunts Point Avenue and Gilbert Place, in Bronx, New York. Plaintiff bought a cigarette from a local bodega and began smoking outside its premises. While smoking, he was approached by Defendant police officers who asked for his identification, which he provided. The Plaintiff did not commit any crime or acted suspiciously, however the officers asked him to place his hands behind his back. When plaintiff asked why, the officers forcibly handcuffed him, and threw him into the police vehicle causing physical injury.
