Description: On November 10, 2012, Plaintiff had finally reached the head of the line for gasoline for his livery vehicle. Defendant Officer Kenneth Hines, who was directing traffic, came over and told Plaintiff that he could not pump the gas. When Plaintiff tried to get back in his car, Defendant Officer Hines pulled him out, threw him to the ground, assaulted him, and pepper sprayed him. Plaintiff was cuffed and put in the back of a squad car for almost two hours before he was taken to the 44th Precinct.
