Complaint
Description: On August 12, 2020, defendants, including Modica, approached and arrested plaintiff without just reasons. Plaintiff had multiple assaults and batteries, committed to his person, by defendants, including Modica. Plaintiff was rear handcuffed by defendants, including Modica, and placed in a NYPD vehicle and transported to 44th NYPD precinct. Upon arrived, plaintiff was searched, questioned, photographed and fingerprinted by or at the direction of defendants, including Modica. Defendants provided false information in order to initiate a criminal prosecution against plaintiff. All charges against plaintiff were unconditionally dismissed.

Description: On November 16, 2019, around 9:30 PM, Plaintiff Alexandr Velazquez was near East 170th Street and College Avenue, Bronx, exited his friend's building on 170th Street and was grabbed by Defendant Officers Jospeph Modica, Andrew Alvarado and John Does 1-10, and Lieutenant Steven Degree, for no reason. When Plaintiff asked why he was being detained, Defendant Officers said "I'll tell you when you get in the car." Then, Defendant Officers Handcuffed Plaintiff and placed him in a police car.
