Description: On December 26, 2018 Plaintiff, an Asian man, entered a subway station, swiped his MetroCard, and passed through the turnstile. Plain-clothes PO John Doe directly observed Plaintiff swipe his MetroCard. Approximately 2 minutes later POs "John" Riquelme and "John" Batsyk stopped Plaintiff and demanded Plaintiff explain why he jumped the turnstile. POs stopped and accused Plaintiff due to discriminatory policing tactics that target persons of color for minor infractions. Plaintiff stated he did not jump the turnstile and offered to demonstrate his card had legitimately been used at the turnstile.
