Description: On March 2, 2020, Plaintiff Tracy McCarter was visited at her Manhattan residence by her estranged and abusive husband, James Murray. Mr. Murray had an extensive history of alcoholism and domestic violence toward Plaintiff. Plaintiff returned from work to find Mr. Murray waiting for her outside her apartment, at which point she allowed him inside to retrieve his medications and sleep on the couch. Once inside, Mr. Murray became combative towards Plaintiff. Mr. Murray pushed Plaintiff into a mirror and choked her. Description: On or about July 30, 2014, Detective Nelson Lopex, Mark Worthington, Carl Worlstrom, Carlos Pagan, Charles Carlstrom forcibly seized and searched plaintiff without a warrant, justification, consent, probable cause. After seizing and searching the plaintiff, defendants detained, handcuffed, arrested, and imprisoned him. On or about July 31, 2014, defendants initiated a criminal prosecution of plaintiff. In or around July 2016, the defendants rearrested the plaintiff on an additional charge of manslaughter. On or about November 14, 2017, all criminal charges against the plaintiff were dismissed.
