Description: On October 3, 2018, the plaintiff, Windel Cesar, was assaulted and battered by defendants, New York Police Officers Carlos Arrrecis and James Garrity, while he was driving near 38th Street and 1st Avenue in the County of New York. The defendants arrested the plaintiff without any probable cause, reasonable grounds, or proper arrest warrant. As a result of the assault and battery upon the plaintiff, Cesar suffered serious permanent, personal injuries as well as emotional injuries from the shame and humiliation of the arrest.
