Gaston, without just cause or provocation and without a court authorized arrest or search warrant, searched, seized, assaulted, and handcuffed the Plaintiff in an unlawful and excessive manner. P.O. Gaston falsely accused Plaintiff of committing the crime of criminal possession of a controlled substance and related charges. Plaintiff endured pain, humiliation, and suffering as a result.

When Plaintiff exited the store he saw an MTA employee he was distantly familiar with being followed by a man yelling threats and holding a box cutter.
