Complaint
Description: On December 23, 2022, NYPD Officers Obieka W. Marshall and Giovanni Garcia (defendants) responded to a 911 call reporting a verbal argument between the Patrick Smith (plaintiff) and his partner. Despite no allegations of violence or illegal activity, the defendants entered the plaintiff’s apartment, questioned both parties, and confirmed he had committed no crime. However, they refused to leave unless he accompanied them. Under pressure, the plaintiff left voluntarily but was then ordered into an ambulance without cause. When he declined and attempted to walk away, the defendants forcibly shoved him into a fence and began assaulting him. The plaintiff was beaten by the defendants and additional NYPD officers...
