Description: On January 4, 2018, Plaintiff was lawfully driving his brother’s car when P.O.s Cannizzaro and Baldares illegally pulled him over. The officers approached Plaintiff’s vehicle and ordered him to step out with no legal basis for doing so. Plaintiff and his vehicle were illegally searched. P.O. Cannizzarro falsely claimed that he recovered an illegal “billy club” from Plaintiff’s driver’s side door and P.O. Baldares falsely claimed he had recovered an illegal “large fixed blade knife” from underneath the back seat. The “billy club” was in fact a small baseball bat, which is not a per se illegal weapon.
