Description: On June 27, 2023 Plaintiff was near his vehicle which was lawfully parked on the street. PO Michael Vasquez, PO Pierre Senat, and PO Francesco Monastra were in an unmarked police vehicle pursuing an individual in an ATV when their negligence caused the ATV to collide with Plaintiff's vehicle. Plaintiff lawfully filmed the scene and did not interfere with police activity. Regardless, POs attempted to stop Plaintiff from filming. When Plaintiff refused unlawful orders to leave PO Vazquez ordered Plaintiff to put his hands behind his back for "standing in the street" and suddenly violently propelled Plaintiff's head, neck, and upper body into the street in a "suplex" move. Description: On March 29, 2022, Tishan Purcell-Holmes was driving with his friend Noel Budran in the Bronx when he was approached by Officer Pierre Senat. After providing his license and registration, Purcell-Holmes was instructed to exit the vehicle and was frisked by officers without being given a reason or explanation. Despite no evidence of weapons or contraband, Officer Senat claimed that Purcell-Holmes had swerved and obstructed his view. His vehicle was then searched by several officers. Purcell-Holmes was subsequently handcuffed and taken to the 47th Precinct, where he was charged with possession of a loaded firearm. Description: On or about October 12, plaintiff received a phone call from his wife informing him that she had been in an automobile accident near the vicinity of 3750 Baychester Avenue, Bronx, New York. Plaintiff immediately responded to the scene and where his wife shortly left after because she did not feel well. While plaintiff was waiting for the tow truck, defendant NYPD officers approached the plaintiff. The officers demanded that he tell his wife to return to the scene, but after failed attempts the officers arrested the plaintiff. The affixed extremely tight handcuffs to his wrists and transported him to the 45th Precinct. Plaintiff remained in custody until October 13th, 2018, when all the charges were dropped.
