Description: On or about March 17, 2012, Plaintiffs were participating in the Occupy Wall Street occupation of Zuccotti Park, a public space, that had been ongoing for 6 months with various levels of NYPD monitoring and searching. Under orders, NYPD officers were to close the park and clear it of people that evening, and gave dispersal orders. Several, but not all of the plaintiffs, heard those orders, but all remained and all were arrested by unidentified NYPD officers.

In the course of their arrest, the Plaintiffs were harmed and mistreated. Plaintiff Carter’s arm was twisted by one officer while another officer kicked him in the abdomen several times. Description: On March 17, 2012, Plaintiff was lawfully present in Zuccotti Park. Defendant police officers accosted Plaintiff, a woman, deliberately grabbed her breast, threw her to the ground, deliberately bent and twisted her wrists, and handcuffed her with flex-cuffs more tightly and violently than authorized by NYPD procedure. Defendant officers placed Plaintiff under arrest despite a lack of probable cause. Plaintiff was held and detained in custody for approximately thirty-one hours. When Plaintiff was finally brought to court and arraigned, her case was adjourned in contemplation of dismissal.
