Description: On October 21, 2015 at approximately 1:30 p.m. Plaintiffs were lawfully sitting on a park bench when PO Marielen Derasmo and Sgt. Richard Hewitt unlawfully stopped, questioned, frisked, searched, seized, falsely arrested, and falsely imprisoned Plaintiffs without legal justification. Other unnamed POs observed the illegal actions and did nothing to prevent them. Plaintiffs were handcuffed and searched without result. POs then transported Plaintiffs to the 52 Precinct where they were criminally processed and detained for approximately 7 hours. Plaintiffs were maliciously prosecuted and each forced to return to court until their charges were ultimately dismissed.
