Description: On July 5, 2020, at approximately 4:50 a.m., the Plaintiff, Marvin Tobon was lawfully present in the courtyard at or near 1158 Boynton Avenue, County of the Bronx, State of New York, not obstructing pedestrian or vehicle traffic or otherwise committing any offense or violation of the law. Mr. Tobon observed eight NYPD officers approach him, and they commanded him not to leave the area as it was potentially a crime scene. Mr. Tobon wa confused and questioned the Officers as to why he was being detained. At this point, a female officer gestured to Mr. Tobon to move back.
