Description: On November 22, 2014, plaintiff was waiting for his cousin to take the train with on 125 Lexington Ave. when defendant officers, without reasonable suspicion, approached and searched plaintiff. After finding legally prescribed medication in its original prescription bottle, defendant officers, without probable cause, arrested plaintiff. Defendant officers then stripped-searched plaintiff at the precinct, and, despite failing to find any contraband materials, informed Manhattan District Attorney's Office that plaintiff was in criminal possession of drugs. Plaintiff was transferred to Manhattan Central Booking where he was held for several hours until the District Attorney's Office declined to prosecute him.

Plaintiff had no involvement in the alleged buy-and-bust drug transaction. Jury found plaintiff not guilty of the only charge against him--criminal sale of a controlled substance in the third degree. Following his acquittal, plaintiff was release from custody, after being incarcerated for nearly eight months at Rikers.
