Description: On April 27, 2013, Plaintiff was in his vehicle. NYPD Officer Wu and other officers approached him. They forcibly pulled Plaintiff from the car, and given a Portable Breath Test that yielded 0.00. Without any lawful basis the Officers arrested Plaintiff, and used excessively tight handcuffs on him. He was taken to the Precinct, where his intoxilyzer exam read 0.00, and the Intoxicated Driver Testing Unit technician found him not to be intoxicated. Nevertheless, the Officers falsely accused him of intoxication while driving offenses.
