Description: On July 14, 2017, at approximately 7:30 p.m., the defendants unlawfully stopped, seized, and detained the plaintiffs, Ariam Kershaw and Alexander Garcia, in an excessive manner with excessive force. The plaintiffs were outside of "206 Samy Gourmet Deli" in the Bronx when they were approached by the defendants, NYPD Officer Mario Dieujuste, and unnamed NYPD Officers John Doe #1 - 5. The defendants proceeded to use excessive force on the plaintiffs by slamming the plaintiffs onto the hood of a car, pressing the plaintiffs against the bar, twisting the plaintiffs' arms, placing tight handcuffs on the plaintiffs, and searching the plaintiffs multiple times. Description: On March 10, 2017, at around 12AM Plaintiff was walking on the sidewalk. At the time, defendant officer’s were in an unmarked police vehcile with license plate HMM 5438. The defendant officer’s came out of the car and approached plaintiff. Defendant officer didn’t say anything to plaintiff before they spun plaintiff around. When plaintiff asked the defendant officers what they were doing, one of the officers told him to “shut up” and that he was being searched and that if he kept talking or moving he would “go to jail”.
