Description: On or about July 30, 2019, in the Bronx, Plaintiff was walking towards a local restaurant when Defendants NYPD Officers WILTSHIRE, GUZMAN and DOES stopped, handcuffed and arrested Plaintiff for a robbery that they witnessed via video to not have in fact taken place. on or about August 1, 2019 Plaintiff was arraigned in Bronx County Criminal Court and Plaintiff CUELLO, on his own, located the video that exonerated him. 30. That CUELLO produced the video that exonerated him to the Office of the Bronx District Attorney. On and between August 1, 2019 and August 28, 2019, Plaintiff made several court appearances until the Office of the Bronx District Attorney dismissed the case.

Complaint
Description: On December 5, 2017, police officer John Garcia improperly arrested Clinton Speller. Speller was properly near 2434 Creston Ave. of Bronx when Garcia approached Speller and asked to raise his hand and to produce his Id. Garcia was accused of having open consumption of alcohol, but Garcia failed to notice that the beer can were in fact unopened. As a consequence of Garcia's malicious prosecution and negligent conduct, Garcia was falsely arrested and detained for about a week. Garcia suffered from emotional trauma and fear. Charges against Speller was subsequently dismissed.
