Description: On January 21, 2021, NYPD officer Joseph Fernandez and other unnamed NYPD officers illegally stopped, seized, searched, battered, assaulted and arrested Plaintiff while she was lawfully present with her daughter and walking towards her daughter's school. Previously, Plaintiff had been assaulted by her neighbor after the neighbor criminally trespassed into Plaintiff's residence. Police officers had arrived and reviewed exculpatory video evidence against her neighbor, but the officers determined there was no probable cause to arrest either party.
