Complaint
Description: On July 16, 2012, plaintiff was waiting for a friend and talking to neighbors when Officers Burns and Russell approached him and accused him of smoking marijuana. Plaintiff denied the accusation, and plaintiff's neighbors also told the officers that plaintiff was not smoking marijuana. Officers then proceeded to arrest him and he was falsely charged with criminal possession of marijuana. Officers fabricated evidence and falsely stated that they'd recovered marijuana from plaintiff. He was held for more than 24 hours before is arraignment in which he was released on his own recognizance.
