Description: On August 9, 2017, the plaintiff purchased a six-pack of beer from Howard Deli Mart (276 Marion Street, Brooklyn, NY) and returned to his nearby home. Upon arrival, he sat on his stoop and conversed with friends. Shortly thereafter, defendant police officers Pearce Martinez and John Doe #1 were called to the deli to respond to an alleged robbery. They approached the plaintiff, stating they needed to arrest him for the theft of a six-pack of beer from Howard Deli. The plaintiff asserted he had paid for the beer and that the surveillance video from Howard Deli would confirm his purchase.
