Description: On October 12, 2014, Plaintiff was arrested by Officer Linhong Li and an identified officer for smoking a cigarette while waiting on a subway platform. Plaintiff was taken to the precinct where he was under the supervision of Officer Li and Officer Carlos Fermin. While there, Officer Fermin punched plaintiff and knocked him unconscious. He woke up the next morning handcuffed to a bed in the hospital with a fractured jaw, nose, a black eye, and swelling on the head and face. Officer Li was present during the assault. The unidentified officer assigned to plaintiff at the hospital told him that he had "messed with the wrong officer." Plaintiff was then taken to booking and charged with disorderly conduct.
