Description: On or about May 23, 2016 Det. Roberto Guaba grabbed, handcuffed, and seized Plaintiff in the 7th Precinct for an alleged robbery. The handcuffs were wrongfully applied so tight Plaintiff's wrists turned red. Plaintiff was taken to another police station then Rikers Island. Plaintiff was held in custody over the course of approximately 3 days or approximately 40 hours. Det. Roberto Guaba caused a malicious prosecution to be commenced against Plaintiff, and after multiple court appearances all charges against Plaintiff were ultimately dismissed on or about July 20, 2016. Plaintiff suffered physical pain and mental suffering as a result of this incident.
