Complaint
Description: Defendant Officers came to Plaintiff's residence and questioned him about his cell phone. Defendant Officers searched Plaintiff's apartment and his body and found narcotics in his pocket. Plaintiff was arrested, taken to a precinct, questioned, and the DA declined to prosecute him. Plaintiff was then transferred to the White Plains PD. The White Plains PD pressed charges that were not specified and later dismissed.

Description: On December 9, 2007, outside the Bellevue shelter in Manhattan, Plaintiff Martin Nnodimele was arrested and, through abuse of process and malicious prosecution, was eventually unlawfully convicted, serving nearly four years, for robbery, as a result of the actions of Defendants, NYPD Officers Donald Derienzo, Yvonne Hughes, Edward Garrity, and David Eddie. Hughes falsely identified Plaintiff as a match for a rendering of a robber on a "wanted" poster, even though he did not match the robber in height, passed the info on to Eddie, who also ignored the lack of a match, who passed the info onto Garrity, who, in arresting Plaintiff, not only ignored the lack of a match but also ignored Plaintiff's denial that he wa...
