After Defendant read Plaintiff his Miranda rights, Plaintiff requested a lawyer be present during questioning, but Defendant denied Plaintiff's requested and arrested him for Second Degree Attempted Robbery without a warrant. The grand jury did not indict Plaintiff based on lack of probable cause. Plaintiff was held on $75,000 bail after his initial arraignment and was never produced in court again.
