Description: On October 20, 2008, as plaintiff was walking along the street, he heard gunshots from afar. Afraid, plaintiff ran to his home. On October 21, 2008, plaintiff received a phone call from, Martinez, a person of interest in the shooting, asking him to fetch clothing from this apartment. Plaintiff complied and was stopped by defendants at Martinez's apartment. Plaintiff was brought to the 104th precinct for questioning and interrogated. He was released several hours later. The following day, Martinez was apprehended and falsely claimed that plaintiff was the shooter. Plaintiff was again taken to the 104th precinct and interrogated.
