Description: On April 21, 2023 Plaintiff was lawfully present at or about 972 Washington Avenue in the Bronx when PO Eliezel Penadiaz, who was present with other unknown POs, discharged his service weapon or a gun and shot Plaintiff without provocation, probable cause, or pursuant to a lawful arrest. Plaintiff is now wheelchair-bound, unable to walk, and will require ongoing medical care. This incident stemmed in part from the City of New York's negligent police officer training regarding how to deal with emotionally-disturbed individuals. The City of New York also had prior knowledge of the improper conduct of PO Penadiaz and other unknown POs but continued to employ them and allow them to be in contact with the public. Pl...
