Description: On May 25, 2014, Plaintiff was walking with a friend. He held a small stick in his hand approximately two feet in length, and tossed it to the side of the street when there were no cars. As they walked into their apartment complex, NYPD Police Officer Angel Rodriguez pulled up in plain clothes and an unmarked car. Without identifying himself, he pushed Plaintiff against a gate and put him in a headlock, and threw him to the ground. Plaintiff was bleeding from his knees and wrist. His mother arrived at the scene, and called 911 to report the incident. Description: Defendant Officers approached Plaintiff 1 as he was about to enter his home, demanded to go inside, and Officer Luti pushed him. After Plaintiff 2 witnessed this and was intimidated, he allowed officers to enter the home. Officer Luti put Plaintiff 1 in a headlock while Officer Rodriguez repeatedly punched him. Officers continued to assault him, then handcuffed him, brought him to the 73rd Precinct, and charged him with OGA, Resisting Arrest, Attempted Assault in the Third Degree, and Harassment in the Second Degree, which were all eventually dismissed.
