Description: On October 23, 2010, Plaintiff and a co-worker were en route to the subway station at Chauncey Street and Broadway in Brooklyn. The Plaintiff proceeded up the stairs to purchase a metro-card. He was approached by Rinvil, Estevez and Appel. Rinvil asked Plaintiff for ID. Plaintiff complied. Defendants accused plaintiff of smoking a cigarette. Rinvil ordered Plaintiff to turn around and place his hands behind his back. Plaintiff began to comply when Estevez sprayed mace into the Plaintiff's face. Plaintiff was thrown on the ground, then down a flight of stairs. Plaintiff flagged down a marked police vehicle.
