Description: On December 11, 2018, at approximately 11:00 p.m., Plaintiff was in the vicinity of 2640 Marion Avenue, Bronx, New York. Police officers, including Detective Derek Rivera, Police Officer Braulio Aponte, and unnamed officers approached Plaintiff without an arrest warrant, probable cause, or any legal justification. The officers stopped, searched, and seized Plaintiff, using excessive force in the process. Plaintiff was subjected to a strip search and maliciously prosecuted. After being detained for over 24 hours and facing multiple court appearances, the charges were eventually dismissed in Plaintiff favor.
