Complaint
Description: On February 9, 2016, Plaintiff was dressed in a Batman costume and lawfully present in front of the American Eagle store at 1551 Broadway, New York, NY. Plaintiff was handcuffed, detained for approximately 30 minutes, and arrested without cause or provocation, issued a desk appearance and maliciously prosecuted by defendant before the case was dismissed as legally insufficient. Plaintiff had committed no illegal act and there was no probable cause to believe he had committed an illegal act. Plaintiff has suffered personal injuries, severe mental anguish and psychological trauma, and his reputation and character were injured.
