Description: On or about January 8, 2008, at approximately 7:00pm, Plaintiff was sitting in his double parked car with a friend. Plaintiff's car was properly licensed, registered, and inspected, displaying proper certification. Plaintiff also had a valid driver's license and did not operate his car recklessly or in a manner justifying a police stop or questioning. Defendants Eiseman and Hujber were driving up the street when they noticed officers from the 32nd Precinct stop to address a fight between a man and a woman. Defendants Eiseman and Hujber stopped to assist with the fight, but instead walked to Plaintiff's car. Plaintiff was not involved in the fight and was just sitting in the driver's seat of his car.
