Description: On September 29, 2003 Plaintiff was leasing a garage when he received a call that the gate was stuck and a truck could not pass through. Plaintiff fixed the gate and shortly thereafter Det. Kevin Roy, Sgt. Neil Nappi, PO Brian Jay, Det. John Hourican, PO Mike Hernandez, Capt. Gerard Staples, Inspector FNU Cully, Det. FNU Booper, and POs John Does 1-10 falsely arrested Plaintiff for possession of a controlled substance. POs caused a malicious prosecution to be commenced against Plaintiff, and a November 2005 trial resulted in a mistrial. Description: On November 18, 2011, plaintiff was inside his apartment located at 1900 Lexington Ave, Apt. 2K, NY, NY, when defendants knocked down the front door and entered. Defendants yelled at plaintiff to get on the floor. Plaintiff complied with the orders to get on the ground and was handcuffed. Plaintiff was arrested and transported to the 25th precinct. Plaintiff was transported to Manhattan Central Booking. After 18 hours in custody, the Manhattan DA declined to prosecute plaintiff and he was released. Defendants present at the scene of the incident observed the violation of plaintiff's rights and did nothing to prevent those violations.
