Plaintiff went over to the car to get the names of the Defendant Officers when they ignored him and Plaintiff went back to his car. Defendant Officers then grabbed Plaintiff, slammed him into the car mirror, arrested him, and charged him with resisting arrest and disorderly conduct.

Description: On November 26, 2011, Plaintiffs Diaz, Taveras and Guzman were in a parked automobile when Defendant Officer Evan Johnson opened Diaz’ door and pulled him out. Defendant Johnson threw Plaintiff Diaz to the ground, assaulted him, and cuffed him. Defendants Taveras and Guzman were similarly pulled from the vehicle and arrested by other officers. All of the Plaintiffs were taken to the 46th Precinct. There Diaz was strip searched, after which he lost consciousness. He was taken for medical treatment and diagnosed with a concussion from Defendant Officer Johnson’s excessive and unprovoked assault.
