Description: On October 17, 2012, Plaintiff was approached by officers while he was standing on the public sidewalk speaking with two acquaintances he encountered on his walk back home from work. Plaintiff was not creating any disturbance nor was he obstructing access to the sidewalk. Nevertheless, the officers, without probable cause or reasonable suspicion of any crime, placed Plaintiff under arrest. Officer Cornea either arrested and or/failed to intervene the actions of his fellow offers when he observed them falsely arresting Plaintiff. Plaintiff was held in police custody for several hours before being given a summons ticket for disorderly conduct and released. All charges against Plaintiff were later dismissed.
