Description: On or about October 18th, 2018, Plaintiff was lawfully outside with a friend when he was approached by PO Tristan Parker, PO Nelson Tejada and PO "John Doe" of the NYPD. PO's threw Plaintiff to the ground and affixed excessively tight handcuffs to his wrists. Plaintiff and his friend were charged with petit larceny and fraudulent accosting. Plaintiff had not committed any crime while handing out his music CDs, only accepting a voluntary $20 donation from one passerby, in exchange for a CD. Plaintiff was detained in NYPD custody for 28.5 hours. At arraignment, Plaintiff was released on his own recognizance. On April 16th, 2019, all charges against Plaintiff were dismissed.

Defendant Officers wrongfully and without probably cause searched, seized and arrested Plaintiff and charged him with criminal possession of a controlled substance. Plaintiff was lawfully on the premises. Plaintiff was incarcerated for approximately 727 days and on December 27, 2018, all charges were dismissed.
