Description: On or about May 4, 2013, Plaintiff was brutally assaulted and battered, and shot with a Taser-type stun gun by Officer Loweth. Plaintiff was at the precinct cell due to an I-card complaint that was deemed illegal. When Plaintiff asked for transfer to a warmer area because of a broken window, Officer Loweth told him to "shut the fuck up." In response, Plaintiff asked Officer Loweth if he spoke to his children in that manner. Officer Loweth, with the aid of four other officers, commenced to assault and batter Plaintiff, shoot Plaintiff with a Taser gun and continue to assault as Plaintiff lay helpless and writhing on the floor.
