Description: On September 17, 2010, Plaintiff Tyrone Gearles was lawfully present in the vicinity at Marcus Garvey Park speaking with some friends when Defendant Officers approached and frisked them without any probable cause or reasonable suspicion. Defendant Officers found nothing, but told Plaintiff he was under arrest for selling marijuana. At the precinct, Plaintiff was strip and body-cavity searched without reasonable suspicion or probable cause. The searches were approved and authorized by Defendant Sergeant Anthony Borelli.
