Description: On May 18, 2020, Plaintiff was waiting for the subway train inside of the subway station in Manhattan, when he saw a fight between someone intoxicated and somebody else trying to steel his wallet. The man who committed the robbery fled the subway station. The victim badly beaten, with a bleeding, bruised and swollen face, approached Plaintiff and another bystander on the platform and asked for help. Plaintiff and the bystander escorted the victim off the platform through the exit gate. Intoxicated, the victim starting to accuse Plaintiff of robbing him.
