Description: On August 5, 2016 at approximately 10:30 p.m., Plaintiff was in the vicinity of a housing complex in the Bronx, dressed in CopWatch Patrol Unit clothing and observed three plain clothed NYPD Officers Defendants Duran, Baez, and Frias questioning and searching two individuals. Plaintiff recorded the encounter on video. When the officers passed Plaintiff, they exchanged words with Plaintiff. Defendants grabbed Plaintiff and his video camera and handcuffed and arrested the plaintiff and brought him to the PSA 7 precinct. Description: Plaintiff, a woman with known mental health issues, was displaying loud behavior in her apartment, prompting her building supervisor to call 911 for an ambulance. Officers from the 43rd Precinct and EMTs arrived at the apartment, along with Plaintiff's sister. Although Plaintiff posed no threat and was alone in her apartment, Defendant Officer Hugh Barry shot her. Plaintiff was transported to the hospital where she was later pronounced dead.
